Public Offer Agreement
This document is the Public Offer Agreement of an online shop http://memerch.store/ (hereinafter reffered to as the "Online Store" and includes significant requirements for provision of sales services.
1. GENERAL PROVISIONS
1.1. This Public Offer Agreement (hereinafter referred to as the "Offer") is the official offer of the Sole Proprietor Novikov Andrey Pavlovich, PSRNSP No. 319595800007740 to any individual wishing to purchase goods (hereinafter referred to as the "Customer"), to conclude a retail sale agreement in the online store remotely with the Seller on the terms specified in this Agreement and contains all the essential terms of the Offer.
1.3. The Online Store has the right to amend the Offer without notifying the Customer.
1.4. The validity of the Offer is not limited unless otherwise indicated in the Online Store.
1.5. The Online Store provides the Customer with complete and reliable information about the goods/service, including information about the main consumer properties of the goods and their current prices.
2. SUBJECT OF THE PUBLIC OFFER AGREEMENT
2.1. The Online Store undertakes to transfer the goods to the Customer that are intended for personal, family, home or other use, not related to entrepreneurial activity based of the Orders placed, and the Customer undertakes to take and pay for the Goods on the terms of the Offer.
2.2. The name, price, quantity of goods and as well as other necessary terms of the Offer are determined on the basis of the information provided by the Seller when placing the order.
2.3. The ownership of the ordered goods passes to the Customer from the moment of the actual payment and transfer of the goods. The risk of accidental loss or damage of the goods passes to the Customer from the moment when the goods are actually transferred to the Customer.
3. COST OF GOODS AND SERVICES
3.1. The prices of the goods are determined by the Seller unilaterally and are posted on the site https://memerch.store/.
3.2. The prices of the goods are indicated in rubles and does not include the transportation cost.
3.3. The payment methood is determined by the Customer when paying for the Goods selected in the Online Store.
4. ACCEPTANCE AND CONTRACTING OF THE PUBLIC OFFER AGREEMENT
4.1. The Customer makes acceptance of the Offer by placing an oder of the Goods in accordance with the terms of the Offer.
4.2. Acceptance of the Offer by the Customer means that he fully agrees with the following provisions:
- registration data (including personal data) is given voluntarily;
- registration data (including personal data) is submitted in electronic form via the Internet communication channels;
- registration data (including personal data) can be used by the Online Store in order to promote goods and services by implementing direct communication with the Customer via communication channels;
- in order to protect Customer's registration data (including personal data) against any fraudulent activities, data can be submitted to the bank, which carries out transactions for payment of placed orders;
- concent on registration data processing (including personal data) given by the Customer is open-ended and can be withdrawn by the Customer or his/her legal representative by submitting a written application sent to the Online Store, or by a request to the email email@example.com.
5. WARRANTIES AND RETURNS
5.1. The warranty for goods is 30 calendar days. Goods of good quality are accepted for exchange or return within 7 calendar days from the date of receiving the Goods by the Customer. Return of goods of proper quality is possible if the goods were not in use and their presentation and consumer properties were preserved. When returning the Goods of proper quality, the Online Store has the right to withhold an amount equal to the cost of the delivery from the Customer. The Customer can clarify the information on the methods of returning the goods by email firstname.lastname@example.org.
5.3. Upon receiving low-quality Goods, the Customer has the right to exchange Goods for similar ones of proper quality or demand a refund. When exchanging low-quality Goods, the Online Store pays for the delivery.
5.4. Refunds are made by returning the cost of the goods via the payment system through which the payment was made or according to the details specified in the application.
6.1. Shipping of the goods to the Customer is carried out on the terms specified by the Online Store in the section "Shipping".
6.2. Claims regarding the quantity, integrity and appearance are not accepted after receiving the goods.
7. VALIDITY OF THE OFFER
7.1. This Offer comes into force from the moment it is accepted by the Customer, and is valid until the acceptance of the Offer is withdrawn.
8. ADDITIONAL TERMS
8.1. The Online Store has the right to assign or in any other way transfer its rights and obligations arising from its relationship with the Customer to third parties.
8.2. The Online Store and the services provided may be temporarily partially or completely unavailable due to technical work or any other technical reasons. The Online Store's technical service has the right to periodically carry out necessary preventive or other work with or without notifying the Customer.
8.3. The relations between the Customer and the Online Store are regulated by Russian legislation.
8.4. In case there are any questions or complaints, the Customer should contact the Online Store by email email@example.com. The parties will try to resolve all disputes that arise through negotiations, if an agreement is not reached, the dispute will be referred to a judicial authority in accordance with the current legislation of the Russian Federation.
8.5. Invalidation of any provions on the Offer recognized by the court does not entail the invalidity of the remaining provisions.
